Previous convictions

It is the insured’s responsibility to disclose his criminal record when purchasing an insurance policy. However, insureds are not necessarily aware of this obligation. Furthermore, not all insurance applications contain any specific questions on the subject. The Chambre de l’assurance de dommages therefore recommends that: 

  • firms adopt a clear policy regarding the insured’s disclosure of a criminal record, in order to properly guide their representatives. In particular, this policy should explain exactly what to do when an insurance application does not include any questions regarding criminal records. 
  • damage insurance representatives act as conscientious advisors and explain to their clients the importance of disclosing a criminal record as well as the possible consequences of failing to do so. 
  • when a client discloses his criminal record, the representative must notify the insurer.
